Los animales en el ordenamiento jurídico Colombiano ¿bienes, seres sintientes o sujetos de derechos?

Abstract

En la presente investigación se efectúa un análisis de tres grandes categorías conceptuales en las cuales han sido ubicados los animales en el ordenamiento jurídico colombiano estas son: Animales como bienes, seres sintientes y sujetos de derechos, ello con ocasión a la entrada en vigencia de la ley 1774 de 2016 “Ley contra el maltrato animal”; promulgada por el poder legislativo en el Estado Social de Derecho de Colombia en la cual se decreta el estatus de seres sintientes a los animales. Para esto se analizará las diferentes teorías respecto del bienestar animal, el reconocimiento de la conciencia anima, y la ética animal, en aras de identificar cómo se han venido desarrollando, teorías como el biocentrismo y el utilitarismo antropocéntrico, y el impacto que estas han tenido en los entornos sociales políticos y jurídicos. Así mismo se pretende realizar un estudio respecto de los avances más importantes respecto a los derechos animales a nivel global en países donde se ha transformado la visión jurídica de los animales como seres sintientes y de especial protección inclusive a nivel constitucional, como, por ejemplo, Austria, Alemania, suiza, entre otros. Así como establecer cuál es el estado de los derechos animales en américa latina de forma de poder entender en qué situación se encuentra el sistema jurídico respecto los avances estudiados en temas de derechos animales.

In the present investigation, an analysis is made of three major conceptual categories in which animals have been placed in the Colombian legal system, these are: Animals as goods, sentient beings and subjects of rights, this on the occasion of the entry into force of the law 1774 of 2016 “Law against animal abuse”; promulgated by the legislative power in the Social State of Law of Colombia in which the status of sentient beings to animals is decreed. For this, the different theories regarding animal welfare, the recognition of animal conscience, and animal ethics will be analyzed, in order to identify how theories such as biocentrism and anthropocentric utilitarianism have been developing, and the impact they have had in political and legal social settings. Likewise, it is intended to carry out a study regarding the most important advances regarding animal rights at a global level in countries where the legal vision of animals as sentient beings and of special protection has been transformed, including at the constitutional level, such as Austria, Germany, Switzerland, among others. As well as establishing what is the state of animal rights in Latin America so as to be able to understand what situation the legal system is in regarding the advances studied in animal rights issues. 8 Key Words: Animals, goods, sentient beings, subjects of law, law, state protection, anthropocentrism, biocentrism, animal protection
