Incidencia del delito de abuso de confianza en la administración de propiedad horizontal en Bogotá, Colombia, durante el periodo 2020 a 2023

Abstract

La administración de la propiedad horizontal en Bogotá ha sido afectada por la mala gestión de los recursos financieros, resultado de la comisión del delito de abuso de confianza calificado, conforme lo establecido en el artículo 250, numeral 4 del Código Penal colombiano, por ser perpetrado sobre bienes comunitarios, situación en la que han incurrido algunos administradores. El objetivo de este trabajo es analizar la incidencia del delito de abuso de confianza en la administración de la propiedad horizontal en Bogotá, Colombia, durante el período 2020 a 2023. Para ello, en primer lugar, se aborda el marco normativo nacional sobre la propiedad horizontal. En el segundo capítulo, se exploran la dogmática y los elementos constitutivos del delito de abuso de confianza, tanto en su forma simple como calificada. Posteriormente, se examina la incidencia del abuso de confianza calificado, conforme al artículo 250 del Código Penal. Finalmente, en el último capítulo, se proponen estrategias basadas en los hallazgos de la investigación para mitigar y prevenir la comisión de este delito en el contexto de la administración de la propiedad horizontal, según lo dispuesto por la Ley 675 de 2001, en Bogotá. La presente investigación es de tipo explicativo con un enfoque cualitativo, y busca identificar cómo afecta el delito de abuso de confianza calificado a la administración de la propiedad horizontal en Colombia, con el fin de proponer estrategias que contribuyan a su prevención y mitigación.

The administration of horizontal property in Bogotá has been affected by the mismanagement of financial resources due to the commission of the crime of abuse of trust by some administrators, typified in the Colombian Penal Code. This crime manifests itself through the diversion of funds from administration fees, the manipulation of service and maintenance contracts, and the misappropriation of resources intended for improvements and repairs. The objective of this work is to analyze the incidence of the crime of abuse of trust in the administration of horizontal property in Bogotá, Colombia, during the period 2020 to 2023. To do this, first of all, the national regulatory framework on property is addressed. horizontal. In the second chapter, the dogmatics and constituent elements of the crime of abuse of trust are explored, both in its simple and qualified form. Subsequently, the incidence of qualified abuse of trust is examined, in accordance with article 250 of the Penal Code. Finally, in the last chapter, strategies are proposed based on the research findings to mitigate and prevent the commission of this crime in the context of the administration of horizontal property, as provided by Law 675 of 2001, in Bogota. The research is explanatory with a qualitative approach, and seeks to identify how the crime of qualified abuse of trust affects the administration of condominium property in Colombia, in order to propose strategies that contribute to its prevention and mitigation.
