El presente estudio tiene como objetivo analizar las acciones urbanísticas ilegales en el municipio de Sibaté (Cundinamarca), que vulneran el marco legal vigente, conociendo su tipificación jurídica, vacíos institucionales, evaluando su efecto sobre la seguridad, el bienestar de los habitantes e identificando lo que ha dado lugar al incremento de este delito y cual es su impacto en la seguridad del municipio. El estudio del caso evidenció que estas prácticas irregulares afectan negativamente el bienestar de los residentes, quienes están constantemente expuestos a catástrofes naturales como corrimientos de tierras, inundaciones e incendios forestales, diagnóstico que reveló que zonas de preservación ambiental como el Barrio Pablo Neruda, la Vereda San Rafael y la parte baja del embalse del Muña han sufrido daños considerables debido a la práctica de este delito. A partir de ello se plantearon acciones como la renovación y aplicación rigurosa del Plan Básico de Ordenamiento Territorial (PBOT), el fortalecimiento de los sistemas de supervisión y control, la puesta en marcha de programas de reasentamiento en zonas de alto riesgo, la salvaguarda de los ecosistemas estratégicos y finalmente aplicación de la norma penal a esta conducta sancionada por la ley, medidas que tienen como objetivo reducir las anomalías y asegurar un crecimiento urbano legal y sostenible.

The present study aims to analyze illegal urban planning actions in the municipality of Sibaté (Cundinamarca), which violate the current legal framework, by understanding their legal classification, institutional gaps, assessing their effect on the safety and well-being of residents, and identifying what has led to the increase of this crime and its impact on the municipality's security. The case study evidenced that these irregular practices negatively affect the residents' well being, who are constantly exposed to natural disasters such as landslides, floods, and forest fires. The diagnosis revealed that environmental preservation areas such as the Pablo Neruda neighborhood, the San Rafael village, and the lower part of the Muña reservoir have suffered considerable damage due to this crime. Based on this, actions were proposed, such as the renewal and rigorous implementation of the Basic Land Use Plan (PBOT), the strengthening of supervision and control systems, the implementation of resettlement programs in high-risk areas, the safeguarding of strategic ecosystems and finally the application of the criminal norm to this conduct sanctioned by law, measures that aim to reduce anomalies and ensure legal and sustainable urban growth
