Los Cerros Orientales de Bogotá, históricamente han sido considerados como una fuente de recursos limitados, de suma importancia para los habitantes de las zonas que lo colindan; sin embargo, por diferentes factores como el olvido gubernamental y la exponencial explosión demográfica, en ellos se han ocasionado daños irreparables, que en virtud de políticas públicas, decisiones del sector privado y acciones judiciales promovidas por ciudadanos, han logrado conjurarse y sostenerse en el tiempo, aunque no de forma incólume. Sobre esta Reserva Forestal se ciernen varios conflictos sociales y jurídicos, como es el caso de los asentamientos ilegales. Increíblemente en estas montañas residen familias que la han habitado por generaciones, inclusive con anterioridad de que emanaran políticas públicas por parte de la administración. En el asunto en concreto, se abordará el caso de las familias Torres y Mayordomo, la cuales habitan la en la Vereda Fátima ubicada en la Reserva Forestal de los Cerros Orientales y frente a las cuales, se procederá a realizar todo un estudio técnico ambiental y jurídico, respecto de los predios de su propiedad, con miras a salvaguardar los derechos que le asisten a estas. Así las cosas se realizará, un estudio histórico de la Reserva Forestal, como de los inicios de las familias Torres y Mayordomo de origen campesino, 8 identificando para el efecto los requerimientos ambientales que estas deben cumplir con miras a que su estadía allí, no sea perturbada por parte de autoridades ambientales. Para tales menesteres, se contará con la ayuda de un equipo interdisciplinar, para valorar y desarrollar la consolidación de un Plan de Manejo Ambiental (PMA), derrotero para lograr un desarrollo sostenible. Con relación al aspecto jurídico se analizará todo un contexto jurisprudencial y normativo, en donde se utilizará la metodología de análisis, tendiente a identificar los pronunciamientos judiciales de mayor fuerza vinculante y gravitacional, en torno a las problemáticas basilares de los Cerros Orientales. Por último se consolidará un documento, primero en su especie frente a la Vereda Fátima, de carácter académico, técnico, ambiental y jurídico, que servirá de apoyo para futuras investigaciones jurídicas respecto a los Cerros Orientales, de especial ayuda para los habitantes de esta Vereda y de un inconmensurable valor para las familias Torres y Mayordomo.
Resumen
The Eastern Hills of Bogotá, historically have been considered as a source of limited resources, of utmost importance for the inhabitants of the surrounding areas; However, due to different factors such as government forgetfulness and the exponential demographic explosion, irreparable damage has been caused to them, which by virtue of public policies, private sector decisions and legal actions promoted by citizens, have managed to conspire and sustain themselves over time, although not in an intact way. Several social and legal conflicts are looming over this Forest Reserve, as is the case of illegal settlements. Incredibly, these mountains are home to families who have inhabited it for generations, including before public policies were issued by the administration. In the specific matter, the case of the Torres and Mayordomo families will be addressed, who live in the Fatima Vereda located in the Cerros Orientales Forest Reserve and in front of which, an environmental technical study will be carried out and legal, with respect to the properties of its property, with a view to safeguarding the rights that assist them. This is how things will be carried out, a historical study of the Forest Reserve, as of the beginnings of the Torres and Butler families of peasant origin, identifying for the effect the environmental requirements that they must meet with a view to their stay there, not being disturbed by environmental 10 authorities. For such purposes, the help of an interdisciplinary team will be used to assess and develop the consolidation of an Environmental Management Plan (EMP), a path to achieve sustainable development. Regarding the legal aspect, an entire jurisprudential and regulatory context will be analyzed, where the analysis methodology will beused, aimed at identifying the judicial pronouncements of greater binding and gravitational force, around the basilar problems of the Eastern Hills. Lastly, a document will be consolidated, first of its kind in front of the Fatima Sidewalk, of an academic, technical, environmental and legal nature, which will serve as support for future legal research regarding the Eastern Hills, of special help to the inhabitants of this Sidewalk. and of immeasurable value for the Torres and Mayordomo families.
